Terms of Use

By using this website or engaging our services, you agree to be bound by the following Terms and Conditions.

Acceptance of the Terms

Your use of this website and our wedding packages and venue space constitutes acceptance of these Terms and Conditions. If you do not agree, please do not use our site or services.

Services Provided

We offer different all inclusive packages tailored to the clients needs and / or desires. Provided services can include but are not limited to: photography, cake, officiant, flowers, treehouse stay and venue. Also, included are wedding website and management and vendor coordination.

 

All services are subject to availability and may be modified or discontinued at our discretion. 

User Responsibility

You agree to:

Provide accurate, current, and complete information on contract form and email correspondence.

Use the website and services only for lawful purposes and in compliance with applicable laws.

Not engage in any activity that disrupts or interferes with the websites operation.

Intellectual Property

All content on this website including text, graphics, logos, images and software is the property of Adirondack Treehouse Wedding or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

Payment and Fees

All fees for services are clearly outlined in Event Contract that must be signed by couple and returned to Adirondack Treehouse Wedding.

30% non-refundable payment required within 14 days of receiving contract.

Remaining payment is due 6 weeks prior to your event date.

General Liability Insurance is required for day of event and will be part of the Event Contract.

Cancellation and Refunds

In the unfortunate case that you would need to cancel your event after you have paid your remaining balance, a refund can only be granted on the second payment, if proper notice was given AND  there are more than 30 days before your event.

Should a catastrophic event occur, we reserve the right to reschedule your event at our discretion.

We reserve the right to cancel services for non-payment or breach of terms, with no refund.

Limitation of Liability

We are not liable for:

Indirect, incidental, or consequential damages.

Delays or failures due to circumstances beyond our reasonable control (e.g. natural disasters, technical outages).

Errors or omissions in content provided by clients.

Our total liability for any claim related to the services shall not exceed the amount paid by you.

Privacy and Data Use

Your personal information is collected and processed in accordance with our Privacy Policy. We do not share your data with third parties except as required by law or with your consent.

Changes to Terms

We may update these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date. Continued use of this site constitutes acceptance of the updated terms.

Governing Law

These Terms and Conditions are governed by the laws of New York State / United States of America and any disputes will be resolved by binding arbitration rather than in court with exception to small claims court (see below).

Disputes shall first try to be resolved through negotiation between the parties.

 

First, a letter describing your claim in detail, including your name and contact information, your legal claim, the specific facts giving rise to your claim (including the date(s) and amount(s) of any relevant transaction or interaction with us), and the requested relief, to P.O. Box 124, Middle Grove, New York 12850. You and We agree to attempt in good faith to negotiate an informal resolution of your claim.

If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute cannot be settled through negotiation within 30 days, the parties agree in good faith to settle the dispute by Mediation administered by the American Arbitration Association, (AAA) under its Consumer Mediation Procedures before resorting to arbitration.

You may also assert claims in small claims court if your claims qualify, so long as the matter remains in such court and advances only on an individual (non-class, non-representative) basis and you or We may seek equitable relief in court for infringement or other misuse of intellectual property rights (such as trademarks, domain names, trade secrets, copyrights).

You agree that you must commence any arbitration or other claim within one (1) year after the dispute arises; otherwise the claim is permanently barred, which means that you will no longer have the right to assert a claim regarding the dispute.

Waiver of Jury Trial. You and We hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury. You and We are instead electing that all claims and disputes will be resolved by arbitration under this Arbitration Agreement, except what has already been specified under Governing Law above. An arbitrator can award on an individual basis the same damages and relief as a court and must follow this Agreement as a court would. However, there is no judge or jury in arbitration, and court review of an arbitration award is subject to very limited review.

Severability

If any part or parts of this Arbitration Agreement are found under the law to be invalid or unenforceable, then such specific part or parts will be of no force and effect and will be severed, and the remainder of the Arbitration Agreement will continue in full force and effect.

Limitations on Liability.  You understand and agree that, to the maximum extent permitted by applicable law, We or Our vendors or service providers (collectively, "We" or "Us" shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the website. In no event shall the aggregate liability of any of us exceed the greater of (A) the total amount paid or payable to Raptive by you for the website
